Great Buddha Statue of Baguashan was built in 1966 and there is no freedom of panorama in Taiwan. The photos violate sculptor's copyright. The same goes for

According to the Copyright Act of Republic of China (2014) Article 58, artistic works on outdoor long term displays in parks may be exploited by any means except as specified in four specific circumstances. One of them is the “Reproduction of artistic works solely for the purpose of selling copies”. Since the uploaded photos are not intended for commercial purposes, why is it not eligible for Commons? In other words, if someone uses our photos for commercial purposes, should that person be the one who has violated the copyright? Just like to clarify this point. Thank you! Latest correspondences from Taiwan Intellectual Property Office (TIPO) reaffirmed that the non-commercial restriction for Taiwanese non-architecture extends to photographic reproductions like these. Since this photo shows the artwork intentionally, this cannot benefit from Taiwanese de minimis (in which the artwork must be incidental or at background). Correspondences in Chinese: [2] and [3].
